Prelim set for man in killing of seal pup

A preliminary hearing was set at the downtown courthouse Sept. 22 to enable a judge to determine if a man accused of killing an elephant seal pup in San Diego should stand trial.

Roy Lee Miller, 45, is charged with cruelty to an endangered or protected animal. He was arrested in July.

Miller is accused of repeatedly striking the seal pup in the head with a rock, leading to its death in February, Authorities said the attack occurred underneath the Sonar Bridge off North Harbor Drive.

Miller faces up to five years in prison if tried and convicted.
